Fabromont AG (FABROMONT) collects, processes and uses your personal data in accordance with these data protection provisions as well as the Swiss Data Protection Act (FADP) and the European General Data Protection Regulation (GDPR). The extent to which the GDPR applies depends on the specific individual part.

In order for us to provide the full range of our services and online content, it is necessary for us to collect information about you from time to time.

This privacy policy and our cookie policy govern below as follows:

  • Which information FABROMONT collects about you when you visit our website, subscribe to the newsletter, contact us by e-mail, letter or otherwise, have a contractual relationship with FABROMONT or you are in contact with FABROMONT in the context of other data processing.
  • For what purpose FABROMONT uses this information that we have collected about you.
  • When FABROMONT will use the data to contact you.
  • Whether FABROMONT discloses your data to others.
  • Your options in relation to the personal data you provide to us.

FABROMONT’s websites may contain links that will take you to other websites owned and operated by third parties. We do not accept any responsibility or liability for the privacy practices of such third party websites. You use these websites entirely at your own risk.

2. What information does FABROMONT collect about me?

FABROMONT processes different types of personal data depending on the purpose.

If you provide FABROMONT with personal data about third parties, FABROMONT assumes that you are authorised to do so and that the data is correct.

For example, FABROMONT may process the following personal data:

  • Name and first name
  • Address
  • E-mail address
  • Telephone number
  • Details of language preferences

Further personal data is possible and will be disclosed on request. You provide FABROMONT with the personal data yourself. However, FABROMONT also reserves the right to obtain personal data from third parties.

2.1. Website and other online content

We receive personal data from you as soon as you log in or participate in FABROMONT's web pages, activities and online content, subscribe to the newsletter, register for contests or the online shop, book tickets for a FABROMONT event, or create an account through FABROMONT's online system. This may include information such as your name, e-mail address, postal address, telephone or mobile phone number, gender or date of birth, and may include information about your use of FABROMONT's websites or your preferences in relation to FABROMONT products.

Please also note that we may sometimes ask you for additional personal data. If that is the case (e.g. for contact forms), we will inform you there why we are collecting your data and how we will use it.

Where we provide personalised web pages, we ask for your consent to review information that third parties have stored about you. This covers your Twitter or Facebook feeds, for example. This is so we can get to know you better and provide more effective customer personalisation. Some of our web pages allow you to sign in via the services of third-party suppliers, such as Facebook. If you choose to log in via the third party app, you will be shown a dialogue box. There, you will be asked for your consent to allow FABROMONT to access your personal data (such as your full name, date of birth, e-mail address and other information that you have made publicly accessible). Please note that any information used for specific services for which you have registered and which is not required will not be stored by FABROMONT.

Contract data is information that arises with the conclusion or processing of the contract. Contract data may also contain personal data that FABROMONT processes (e.g. contact details).

If necessary, FABROMONT can process the following data:

  • FABROMONT can process or edit photos or videos in which you are recognisable (e.g. from events and trade fairs).
  • We may collect data about who attends such events.

3. For what purposes does FABROMONT use the information it collects about me?

FABROMONT will use your personal data for a number of purposes as listed below (the legal basis is Article 6 para. 3, FADP and Article 6 para. 1, GDPR.

  • to make our websites, activities or online content available, as well as information about how we handle your enquiries and requests.
  • to provide you with the most user-friendly online navigation.
  • for the purpose of administration, it may be possible in certain circumstances for FABROMONT to contact you, particularly in relation to certain services, activities or content for which you have registered.
  • In the areas where we offer personalised web pages, we may analyse the information you provide as well as your activity on our web pages. This is so we can offer you more relevant and even better customised services.
  • We may even show you relevant advertisements on third party websites.
  • In order to contact you in relation to the information you have entered, including the content you have provided and for the overall benefit of communication.
  • We may also use IP addresses and device identifiers to identify users’ locations to prevent disruptive use, as well as to determine the number of visits from different countries and whether you are using the websites from Switzerland or another country. If you access the websites from outside Switzerland, you may be redirected to the international FABROMONT website.
  • In addition, we may also use and share information in aggregate form (so that individuals cannot be identified) for marketing and strategic planning purposes.

If FABROMONT wishes to use your personal data for other purposes, we will notify you in advance.

  • to maintain our IT security (in particular to monitor the performance of our website).
  • to fulfil the services requested by you and for the purpose of contract fulfilment.
  • for internal administration (e.g. in the context of bookkeeping or archiving data).
  • to comply with legal requirements (e.g. to process complaints, prevent and investigate criminal offences or other misconduct) and assert claims.

When processing data, FABROMONT observes various data protection processing principles, e.g. the principles of lawfulness, appropriateness, purpose limitation, transparency and data security.

4. When will FABROMONT contact me?

FABROMONT can contact you in the following cases:

  • In relation to a service, activity or online content for which you have registered to ensure that FABROMONT can provide the websites. This includes, but is not limited to, verifying your e-mail address when you register for a FABROMONT account or to assist you in resetting your password.
  • In relation to any correspondence that we receive from you and any comments or complaints you may have about FABROMONT products or web pages.
  • to invites you to participate in surveys about FABROMONT (participation is always on a voluntary basis).
  • to inform you of any material changes in FABROMONT's policies and practices, and
  • for marketing purposes, as described in Section 5.

We will never contact you to ask for your FABROMONT account password or other login details. Please exercise extreme caution when receiving e-mails or phone calls from persons asking for this information and claiming to be acting on behalf of FABROMONT.

5. Will I be contacted for marketing purposes?

FABROMONT will only send you marketing e-mails or contact you for marketing purposes via FABROMONT's platforms if you have consented to this.

In certain countries, we offer regular newsletters to inform you about FABROMONT events, products and online content that may be of interest to you.

We may personalise the content of such messages on the basis of the basic information you have provided to us and you use of the FABROMONT websites.

6. Will FABROMONT share my personal data with others?

At FABROMONT, your information is carefully stored and not forwarded.

An exception applies where disclosure of your information is required or permitted by law (for example, to government and law enforcement authorities, including transfer for the purpose of protecting children and minors), or as otherwise set out in this Privacy Policy.

Trusted partners are another exception. In order for us to provide you with the best possible experience with FABROMONT, we need to ensure that our service delivers on the promise today and in the future. Our trusted partners, i.e. companies we work with mainly in the IT and the marketing sectors, make it possible. In such a case, our partners process certain data, always just as part of a pre-defined framework and for the purposes clearly indicated by FABROMONT. Data transfer usually takes place in the case of cooperation with a sub-contractor (e.g. a marketing agency) or a service provider (e.g. a data storage service provider). In any case, the transfer of data does not relieve the transferor of the responsibility for their processing. Data may also be transferred to public authorities, provided it is authorised and requested under applicable law, but never in any other case.

7. Inappropriate content and age verification on FABROMONT's websites.

If you post or submit any content to FABROMONT's websites or social media in any location that could reasonably be considered offensive, inappropriate or objectionable, or otherwise engage in conduct that could interfere with any services provided by FABROMONT, FABROMONT may remove such content.

8. How long does FABROMONT store my data?

We store your personal data in our systems for as long as is necessary for the activity in question. If you delete you FABROMONT account, your personal data will also be deleted immediately. The remaining data will be anonymised for the purpose of evaluation. For more information on deleting your FABROMONT account, see Section 9 below.

If you submit content to us along with your personal data (UGC User Generated Content (user-created content)), our Terms of Use govern how long we store such material.

If you have not used your FABROMONT account in the last year, your account may be classified as “dormant” and deleted in accordance with this Privacy Policy. We will send you an e-mail to make you aware of this before we delete an account. Therefore, please check your inbox regularly for such e-mails from us.

9. Can I delete my FABROMONT account?

You can delete your FABROMONT account at any time.

As explained in Section 8 above, deleting your FABROMONT account will ensure that all personal data that we have stored about you is deleted. This also means that any data we have collected about how you use FABROMONT's websites will be anonymised.

However, deleting your FABROMONT account will not delete any data you have shared with FABROMONT for reasons other than those related to your FABROMONT account. If, for example, you have signed up to receive notifications of FABROMONT events, we will continue to store your data in order to provide this service to you in the future.

10. Browser cookies

Please read the cookie settings, which describe what cookies are, how we use them and the ways you can restrict or refuse the settings of cookies.

11. Google Analytics

Collected data
Information on the browser type/version, operating system, referrer URL (URL of origin), IP address of the accessing computer, time of the server request, HTML pages visited, number and duration of the sessions. The IP address is shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. If necessary, the full IP address is transferred to a Google server in the USA and only shortened there.

Purpose and legal basis of the processing
The purpose of the collection is the needs-based design of our website. The legal basis for the collection is a legitimate interest in providing you with a good service. (Art. 6 para. 1 letter f of the General Data Protection Regulation DSGVO).

Additional information
Recipients of the data are internal offices at FABROMONT and trusted partners who are consulted for data analysis.

The duration of the storage is 38 months.

We also use Google Analytics to evaluate data for Double-Click cookies and also AdWords for statistical purposes. If you do not want this, you can deactivate it via the Ads Preferences Manager:

12. Changes to FABROMONT's Privacy and Cookie Policy

We may possibly make changes to this Privacy Policy from time to time: therefore, you should review the policy each time you submit personal data to FABROMONT. On this website you will see the most current version of the policy. if you do not consent to the changes made, you should not continue to use FABROMONT's websites or submit any further personal data. You also have the option of deleting your FABROMONT account or unsubscribing from the newsletter at any time. In the event of any significant changes to the Privacy Policy in relation to the handling of personal information, we will notify you directly with more specific details.

13. Contacting FABROMONT about this Privacy Policy

In addition, you can contact us regarding personal data requests. In such cases, we ask you to prove your identity by means of two documents suitable for identification. In accordance with our legal obligations, we will make reasonable efforts to provide, correct or delete any personal data we have stored about you, as appropriate. 14. Your data protection rights

In data protection matters, we would like to comply with international regulations, guidelines and industry standards and are happy to confirm that you can assert the following rights in relation to your data (Article 25 ff. FADP and Article 15 ff. GDPR). You have the right to information, to correction and to deletion of your data. In addition, you have the right to restrict processing and the right of objection, as well as the right to data portability and revocation.

You can revoke your consent to the processing of personal data at any time by contacting us at marketing@fabromont.ch. This also applies to the revocation of consent given to us before 25 May 2018. The revocation of consent shall not affect the lawfulness of processing carried out on the basis of the consent before the revocation.

If you assert rights as a data subject, we must verify your identity. The listed data subject rights are then subject to legal prerequisites and restrictions, which means that the exercise of rights is not always possible in full.

15. Obligation to provide data

If you enter into a business relationship with us, you must provide such personal data that is necessary for the establishment and performance of a business relationship and the fulfilment of the associated contractual obligations or which we are legally obliged to collect. Without this data, we will usually have to refuse to enter into the contract, to provide products and services or we will no longer be able to perform an existing contract and may have to terminate it.

16. Right of objection

You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you in accordance with Article 37 FADP and Article 21 GDPR. This also applies to profiling within the meaning of Article 5 letter f FADP and Article 4 para. 4 GDPR. If you object, we will no longer process your personal data unless one of the following conditions is met:

  • we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedom;
  • processing serves the assertion, exercise or defence of legal claims.
Right of objection to the processing of data for advertising purposes

In individual cases, we process your personal data in order to carry out direct advertising. You have the right to object at any time to the processing of personal data relating to you for the purposes of such advertising; this also applies to profiling insofar as it is connected with such direct advertising. If you object to processing for direct advertising purposes, we will no longer process your personal data for these purposes. The objection can be addressed to the data controller without any formalities.
